Oh to be a fly on the wall in those Sony town halls and meetings trying to manage the backlash from the string of missteps they seem to be making. Meanwhile, every other console gaming company is watching and pivoting to not make those same mistakes. XBOX had the smallest physical gaming market share and they are just swooping in and scooping up all the customers Sony said don’t matter. I suspect we will see just how big physical gaming is with increased sales for Nintendo, Xbox, Sega and every other company especially heading into the holiday season where many companies see the largest increase in sales.

Sony will use the decreased “physical sales” in their company to double down on their decision to abandon the physical gaming media market despite what I suspect will be increased physical game sales in Q4 across the industry as a whole. No ownership of a digital game per Capital Records LLC v Redigi (2013) so Sony decides to call consumers naive for believing “buy now” and “confirm purchase” mean a consumer is actually purchasing something? Even Sony didn’t hang their hat on the EULA protecting them the way people in the comments section love to use as their main argument against physical media game sales ending.

The reason these attacks against physical game ownership ending are so important is because it’s where ownership of games ends under the Redigi case and the first sale doctrine under 17 USC sec 109 thereby allowing a pricing monopoly on hardware specific systems like in console gaming as a whole.
